About this policy

Open Bracket is an Australian sole trader business (ABN 16 308 140 798) (referred to in this policy as Open Bracket, we, us or our).

This policy explains how we collect, use, disclose, store and protect personal information when you visit our websites, request or purchase a digital product, download a resource, subscribe to our communications, contact us or otherwise deal with us.

It applies to openbracket.com.au, weddingbriefstudio.com.au, and any other website, tool or digital product we operate.

Open Bracket is a small business, and the Privacy Act 1988 (Cth) may not apply to all of our activities. We handle personal information in accordance with the Australian Privacy Principles regardless. Being small is not a reason to hold someone's information carelessly. We also comply with other applicable laws, including the Spam Act 2003 (Cth).

Personal information we collect

The kinds of personal information we may collect include:

  • your name and email address;
  • billing and transaction details, if and when we offer paid products and you purchase one;
  • information you provide when requesting a download, subscribing to communications, completing a form, responding to a survey or contacting us;
  • records of our communications with you;
  • information about the products, downloads or content you access;
  • limited technical information that may be recorded automatically by the platforms used to operate our websites, newsletter or digital tools, such as your IP address, browser type, device information and access logs; and
  • your marketing preferences, including any consent you give or withdraw.

We do not intentionally collect sensitive information and ask that you do not provide it unless it is reasonably necessary for a particular interaction with us.

How we collect personal information

We generally collect personal information directly from you when you:

  • subscribe to our newsletter and receive a tool or resource provided with it;
  • purchase or access a digital product;
  • complete a form or survey;
  • contact us by email or through our website; or
  • otherwise interact with us.

We may also receive limited technical or delivery information from service providers that help us operate our websites, send our newsletter, host files or provide digital tools. For example, our email provider may tell us whether an email was delivered, opened or clicked, depending on your email settings and the provider's functionality.

Why we collect and use personal information

We may collect and use personal information to:

  • register and manage your newsletter subscription;
  • send you the Open Bracket newsletter, including the tool or resource offered with the newsletter;
  • provide, administer and support our digital tools and products;
  • process and maintain records of purchases;
  • respond to questions, requests, feedback or complaints;
  • communicate with you about a product, download or transaction;
  • operate, maintain, secure and improve our websites, products and services;
  • understand whether newsletter emails and included links are being delivered and used;
  • prevent misuse, fraud or security incidents;
  • meet our legal, accounting and record-keeping obligations; and
  • send newsletter content and related marketing communications that you agreed to receive when subscribing.

We will not use your personal information for a purpose that is unrelated to the purpose for which it was collected unless you have consented or the use is otherwise permitted or required by law.

Our browser-based tools

Some Open Bracket products are self-contained browser-based tools that you access through a secure web link. Although the tool is hosted online, its working functions run in your browser on your own device.

These tools run entirely on your device. Anything you enter into them — including any draft you save to return to later — is stored only in your own browser, on your own computer. It is not transmitted to us. We cannot access, recover or view what you enter, or any document you produce with the tool, and we hold no copy of it.

Because that information never reaches us, we cannot retrieve a lost draft for you. Clearing your browser data, or using a different browser or device, will remove any draft saved on the original one.

The only personal information we receive in connection with a free browser-based tool is the email address you provide to request access, together with the delivery information described in section 6.

Newsletter, tools and marketing emails

When you provide your email address through our newsletter signup form, you are subscribing to receive the Open Bracket newsletter. A digital tool, download or other resource may be included with, linked from or delivered as part of that subscription. Where a tool or resource is offered, access is typically provided through a link in the confirmation email. The link may open a browser-based tool hosted on an Open Bracket website or provide access to a file hosted by us or our email provider.

The newsletter may include practical tools, information, updates, offers and information about Open Bracket products and services. We will make this clear at the point of signup so that you understand the kinds of emails you are agreeing to receive.

Marketing emails will identify Open Bracket as the sender and include an unsubscribe option. You may unsubscribe at any time by using the link in an email or contacting us at hello@openbracket.com.au. We will action unsubscribe requests within the period required by law. Unsubscribing from marketing will not prevent us from sending non-promotional messages that are reasonably necessary to provide something you requested, complete a transaction, respond to you or administer our relationship with you.

Cookies, local storage and analytics

We do not use analytics, tracking or advertising cookies on our websites, and we do not run website analytics tools to profile visitors.

Two things do happen in your browser, and we would rather name them than leave them implied:

  • Our newsletter signup form is provided by our email platform (see section 8) and may set cookies necessary to operate the form and to recognise you if you are already a subscriber.
  • Our browser-based tools may use your browser's local storage to save a draft on your own device so you can resume work. This is not a cookie, is not sent to us, and is not accessible to us.

The service providers that host or operate our websites may also process limited technical information necessary to provide, secure and maintain their services.

If we introduce website analytics, cookies or advertising technologies in the future, we will update this policy and provide any notice or consent mechanism required by applicable law before or when those technologies are introduced.

When we disclose personal information

We may disclose personal information to trusted service providers that help us operate the business, including providers of:

  • website and file hosting;
  • cloud storage and database services;
  • email delivery and mailing-list management;
  • payment processing and ecommerce services;
  • technical support;
  • accounting, legal and professional services; and
  • security, fraud prevention and business administration.

We currently use Kit to manage newsletter subscriptions, send newsletter emails and host files delivered with them. Kit processes subscriber information on our behalf and may also process delivery, open and click information associated with newsletter emails.

Some Open Bracket products use Supabase to provide database, authentication, file storage or other technical functions. Where this applies, information entered into or generated through that product may be processed and stored through Supabase to the extent necessary to provide it. This does not apply to the browser-based tools described in section 5: although those tools may be accessed through an Open Bracket website, the working information entered into them remains locally in the user’s browser and is not sent to us, Supabase or another third party.

We provide these service providers only with the information reasonably required for their role. They may handle information under their own privacy policies and terms.

We may also disclose personal information where required or authorised by law, to protect our rights or the safety of others, to investigate suspected fraud or misuse, or in connection with a proposed or completed sale or transfer of all or part of the business.

We do not sell or rent personal information. We do not trade in personal information.

Overseas disclosure and storage

Some of the service providers we use, including Kit and, where applicable, Supabase, may store or process information outside Australia, including in the United States and other countries in which their systems, related companies or subcontractors operate.

The privacy and data protection laws in those countries may differ from Australian law. Where reasonably practicable, we select reputable providers and use available contractual, security and account controls to protect the information they handle for us.

Because our providers and their data-hosting locations may change, please contact us if you would like current information about the countries in which your personal information may be processed.

Data security

We take reasonable steps appropriate to the nature of our business and the information we hold to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. These measures may include access controls, password protection, secure service providers, software updates and limiting access to people who need the information for a legitimate business purpose.

We also limit what we collect in the first place. Our browser-based tools described in section 5 are built so that the information you work with stays on your own device, which means there is no copy of it for us to secure or to lose.

No internet transmission or storage system is completely secure. You provide information online at your own risk, and we cannot guarantee absolute security.

If we become aware of a data breach, we will assess and respond to it promptly and make any notifications required by applicable law.

How long we keep personal information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, to administer our relationship with you, and to meet legal, accounting, dispute-resolution and record-keeping requirements.

When information is no longer reasonably required, we will take reasonable steps to delete it, destroy it or de-identify it, subject to any legal or technical requirements that require or justify retention.

If you unsubscribe from marketing, we may retain limited information needed to record and respect your unsubscribe request.

Accessing or correcting your information

You may ask us to provide access to personal information we hold about you or to correct information that is inaccurate, incomplete or out of date.

Please contact us at hello@openbracket.com.au. We may need to verify your identity before acting on a request. We will respond within a reasonable period and, if we cannot fulfil a request, will explain why where it is reasonable and lawful to do so.

Requests to delete information

You may ask us to delete personal information we hold about you. We will take reasonable steps to do so where the information is no longer required, subject to legal, accounting, security, transaction-record and dispute-resolution requirements.

Links to other websites

Our websites or digital products may contain links to third-party websites or services. We are not responsible for their privacy practices. You should review the privacy policy of any third party before providing personal information to it.

Children's privacy

Our websites and products are intended for adults and are not directed to children under 18. We do not knowingly collect personal information from children. If you believe a child has provided personal information to us, please contact us so we can consider appropriate action.
